Facebook could have to pay 'billions' in damages in class action lawsuit over facial recognition

Facebook is going to have to face a class action lawsuit over the alleged misuse of its facial recognition technology, a US District judge has ruled.

The decision by a U.S. district judge means the company could be sued by millions of USA users. It alleges Facebook is in violation of an IL state law that prohibits the collection of biometric data without written consent.

According to the judge's order, damages could rack up to billions of dollars if Facebook loses.

"If you've never been tagged in a photo on Facebook or have untagged yourself in all photos of you on Facebook, then we do not have this summary information for you."

Facebook could have to pay billions of dollars in damages in a class action lawsuit over facial recognition, according to various reports. Among others, the company says its photo-tagging feature isn't covered by the IL law, because Facebook doesn't have servers in IL. Per Facebook's request, the case has been moved from IL to California.

Facebook could face fines of $1,000 to $5,000 for each time it used a person's biometrics without permission.

The feature is not available to users in most countries, including the United Kingdom - and can be turned off in settings for US users.

Facebook also unsuccessfully contended that the consumers shouldn't be able to proceed as a class for numerous reasons, including that any injuries to consumers require individual determinations.

Like many features which bear privacy implications, the tag suggestion is enabled by default-a move that upset some watchdogs, who believe any function providing access to data should be opt-in.
