NASCAR CEO Brian France charged with DUI

Brian France

France was held overnight in The Hamptons before being released just after 9 a.m. ET on Monday after his arraignment.

France, 56, was pulled over and arrested about 7:30 p.m. Sunday near the Sag Harbor waterfront, authorities said.

As law enforcement communicated with him, they became suspicious that he was intoxicated and had him undergo a field sobriety test, which he reportedly failed. France was searched and police found oxycodone pills in his possession, he added.

Brian France also released a statement following his arrest: "I apologize to our fans, our industry and my family for the impact of my actions last night".

Seventh person dies as northern California wildfires spread
An inmate firefighter pauses during a firing operation as the Carr fire continues to burn in Redding, California on 27 July 2018. The fire burned slowly for days before winds suddenly whipped it up last week and drove it furiously through brush and timber.

Effective immediately, Jim France - Brian's uncle - will act as the interim chairman and CEO of NASCAR.

At this time, neither France nor NASCAR appear to have commented on the arrest. The legal limit in NY is.08. "We take this as a serious matter and will issue a statement after we have all of the facts", Nascar said in a statement. France's father - Bill France Jr. - then ran NASCAR from 1972 until 2000. The maximum jail term is one year.

NY law defines criminal possession of a controlled substance in the seventh degree when a person knowingly and unlawfully possesses a controlled substance. In addition, a fine of up to $1,000 or twice the amount of the individual's gain from the crime may be imposed.

The Washington Post suggests TMZ's BAC report is true, in that under NY state law, a DWI charge applies to BAC of.08 or higher, and Aggravated DWI applies to BAC of 0.18 or higher; France was charged with the latter.
