Musk, who has drawn attention to the company with a series of social media spats, was filmed smoking marijuana and drinking whisky in a 2-1/2-hour live web show with comedian Joe Rogan that swiftly spread across Instagram and other popular apps.

All these antics have led many business observers to call for Tesla's board to get help for Musk and relieve him of some of his responsibilities.

The Tesla CEO mused about life and work with Rogan over whiskey and a marijuana joint.

Musk, seemingly referencing former president Bill Clinton, went to Twitter to say that to say, "remember, I did not inhale". Rogan asked, noting that Musk probably had not "because of stockholders".

Musk offered a frank and vulnerable look into his life for The New York Times in August, describing his long hours, isolation and how he took Ambien for sleep.

"Musk will be sued - not because of his hopes, but because he deserves to be sued", responded the diver's attorney, L. Lin Wood, adding that "Elon Musk's ongoing campaign of publishing vile and false accusations against Mr. Unsworth is outrageous".

Meanwhile, the company announced in a regulatory filing the departure of Morton, who is quoted by Tesla as stepping down due to the level of public scrutiny and the pace at the company but not over any disagreements with Tesla's leadership or its financial reporting. "Just ignore them", Musk, 47, said in an email to employees that was republished as a blog post.

Recreational marijuana is legal in California, but Musk had previously dismissed questions about whether he used the drug.

Tesla's Chief People Officer Gabrielle Toledano is on a leave of absence since late August, while Doug Field, Tesla's senior vice president of engineering, took a leave of absence in May and eventually did not return. "Laurie Shelby, who heads the company's environmental, health and safety efforts, and Cindy Nicola, head of global recruiting, are the last remaining female executives at the company", reported TechCrunch at the time of the announcement.

Tesla representatives were not immediately available for comment Friday morning.

Last month's "go private" plan caused Tesla's shares to spike upward, but when the idea fizzled, the stock took a beating. But in an unexpected turn this week, Musk revived the dispute, this time referring to Unsworth as a "child rapist", and urging him to sue.
