USA government considers ban on flavored e-cigarettes over youth 'epidemic'

The Food and Drug Administration is threatening to pull flavored electronic cigarettes off the market if the tobacco industry doesn’t do more to combat growing use of the products by children and teens

US health officials are sounding the alarm about teenage use of e-cigarettes, calling the problem an "epidemic" and ordering manufacturers to reverse the trend or risk having their flavored vaping products pulled from the market.

Five of the biggest e-cigarette manufacturers - JUUL, Vuse, MarkTen, blu e-cigs, and Logic - must also report to the agency within 60 days with plans to address the concerns, or face penalties, it said.

Juul Labs, which controls about 70% of the market, said in its statement that "appropriate flavors" play a role in adults changing their smoking habits, but added that they "are committed to preventing underage use of our product, and we want to be part of the solution in keeping e-cigarettes out of the hands of young people". "It's now clear to me, that in closing the on-ramp to kids, we're going to have to narrow the off-ramp for adults who want to migrate off combustible tobacco and onto e-cigs".

While e-cigarettes are thought to be less harmful than regular cigarettes, it's still unclear of the impact of long-term use. They noted the survey did not ask specifically about Juul, a sleek, heavily-marketed e-cigarette brand that exploded onto the market and accounts for 70 percent of US sales, according to analyst estimates.

"If young adults go online and buy 100 units of a product to sell to teens, that activity ought to be easy for a product manufacturer to identify", said Gottlieb.

However, Gottlieb claims e-cigarette brands haven't done enough to stop kids from using the products.

Gottlieb reiterated his belief that certain e-cigarette liquid flavors - including sweet ones such as mango and cucumber, popular among teenage Juul users - are particularly enticing and even marketed directly to children.

In April, the Minnesota Department of Health and the Minnesota Department of Education sent a joint letter and toolkit to school districts across the state, warning them of the dangers of e-cigarettes and vaping products and providing them with resources for addressing the issue in schools.

Most of the violations found in the undercover blitz, conducted from June through August, were for the illicit sale of Vuse, Blu, JUUL, MarkTen XL and Logic e-cigarette products, according to the FDA.

"JUUL Labs will work proactively with FDA in response to its request". Youth tobacco prevention is a priority for our companies.

"What we have learned from our experience with cigarettes and other products, is it is important to restrict sales to kids, but if you make products appealing to kids, market them in ways to attract kids, you can be certain kids will get them", Myers told AFP.

Jefferies is also bullish on how the FDA's actions will affect major tobacco players.

And the agency has issued more than 135 No-Tobacco-Sale Order Complaints, which, according to the FDA, "can result in retailers being prohibited from selling tobacco products for specified periods of time".
