Weinstein wins dismissal of criminal charge for alleged sex assault

A NY judge on Thursday dismissed one of six sexual assault allegations against disgraced movie mogul Harvey Weinstein, which defence lawyers claim taints the entire case against him.

The Sept. 12 letter from Assistant District Attorney Joan Illuzzi-Orbon to defense lawyer Ben Brafman was filed under a protective order, which Justice James Burke lifted Thursday.

"In short, your honour, we are moving full steam ahead", she said.

The witness reportedly told this to an NYPD detective past year.

Weinstein still faces charges over allegations that he raped a woman in his hotel room in 2013 and sexually assaulted a different woman in 2006.

Weinstein appeared in Manhattan Criminal Court on Thursday morning as Judge James Burke chose to dismiss count six of the eight-count indictment against the 66-year-old film producer.

The Latest on the Manhattan district attorney's decision to drop some charges against Harvey Weinstein. Outside court, he suggested that Evans should be prosecuted criminally for perjury.

In a story published a year ago Wednesday, Evans told The New Yorker that Weinstein forced her to perform oral sex during a meeting at his office in 2004.

The witness told prosecutors that she and Evans met Weinstein in a bar during summer 2004.

In a statement, a lawyer for Evans said she was disappointed by the DA's decision to "abandon" her.

The 66-year-old father of five, out on a $1 million bail and forced to wear a Global Positioning System monitor, attended the latest court hearing and denies any non-consensual sexual relations.

"According to the Witness.the Complainant [Evans] told the Witness that.the Complainant had gone to the defendant's office, where the Defendant told her, in substance, that he would arrange for the Complainant to receive an acting job if she agreed to perform oral sex upon him". He also said he believed a police detective had corruptly attempted to influence the case by keeping a witness from testifying about her misstatements.

He is now free on $ 1 million bail.

The defense said it would also subpoena police interview records after claiming an NYPD detective "may have unfairly tainted these proceedings" when he prepared Evans for her testimony. "The evidence shows that the criminal case against him is strong".

The Associated Press generally does not identify people who say they are victims of sexual assault unless they consent to being identified publicly, as Evans has.

New York Police officials poured on the pressure, too, saying publicly they believed they had gathered ample evidence to make an arrest.
