Appeals court halts Trump attempts to end DACA

A U.S. appeals court in California ruled on Thursday that President Donald Trump's administration must continu

A three-judge panel of the 9th U.S. Circuit Court of Appeals on Thursday chose to keep in place an injunction blocking Trump's decision to phase out the Deferred Action for Childhood Arrivals program.

A liberal-leaning California-based federal appeals court that has often ruled against President Donald Trump dealt him another setback this week in a major immigration case and soon could be asked to weigh in on a pipeline project he has championed.

DACA, established by President Barack Obama in 2012, has enabled almost 700,000 undocumented immigrants who arrived in the United States as children, known as Dreamers, to apply for renewable two-year work permits and postponements of deportation.

Trump has taken a stern stance against illegal immigration.

"And, upon review, we conclude that plaintiffs are likely to succeed on their claim that the rescission of DACA - at least as justified on this record - is arbitrary, capricious, or otherwise not in accordance with law", Judge Kim McLane Wardlaw wrote.

The program was initiated under the administration of former President Barack Obama.

The legality of the program is not at issue in this particular case.

The 9th Circuit ruling does not impact a nationwide injunction to preserve DACA issued by U.S. District Judge Nicholas Garaufis in Brooklyn in February, which also has been appealed.

In a post on Twitter, the American Civil Liberties Union (ACLU) said: "DACA is and will always be constitutional".

"The DACA will now hopefully go to the Supreme Court where it will be given a fair decision", Trump told reporters.

The Trump administration has said it moved to end the program past year because Texas and other states threatened to sue, raising the prospect of a chaotic end to DACA. The lower court had actually dismissed this particular claim, but the circuit court reasoned that the Dreamers in this case had presented enough evidence of animus that they should be able to make their Equal Protection argument at the trial level.

Sessions told then-Acting U.S. Department of Homeland Security Secretary Elaine Duke in a letter on September 4, 2017, that the previous administration did not have the authority to establish DACA.

In response, many lawsuits were filed across the USA including one in California. A judge overseeing that lawsuit and four others ruled against the administration and reinstated the programme in January.

U.S. District Judge William Alsup rejected the argument that Obama had exceeded his power in creating DACA and said the Trump administration failed to consider the disruption that ending the program would cause.

In April, a third federal judge, in Washington, D.C., also ruled against the administration. Trump administration lawyers have argued that the lawsuit seeks to direct federal environmental and energy policies through the courts instead of through the political process.
